Terms of service
Client Service Agreement
Flowers to be received in Spring Hill and placed in the front porch flower bin in a container with water in it. Client agrees to bring flowers at the agreed upon time. If client brings flowers outside of scheduled time this is at their own risk (exposure to the environment for extended periods of time).
Parties:
Nashville Floral Preservation is known as "Contractor"
and
Client entering into agreement is known as "Client"
Collectively, all of the above people or businesses entering this Agreement will be referred to as the "Parties."
Purpose of the Agreement
Client wishes to hire Vendor to provide services relating to 'Floral Preservation' as detailed in this Agreement. Vendor has agreed to provide such services according to the terms of this Agreement.
Terms
You are contracting with Nashville Floral Preservation to produce a unique hand-crafted product involving the use of vegetative medium which means that not only will each product be unique, but it will be different from your original fresh floral arrangement. You acknowledge as follows:
STYLE RELEASE
Client has spent a satisfactory amount of time reviewing Contractor’s work and has a reasonable expectation that Contractor’s Services will produce a reasonably similar outcome and result for Client. Contractor will use reasonable efforts to ensure Client’s services are carried out in a style and manner consistent with Contractor’s current portfolio and services, and Contractor will try to incorporate any suggestions Client makes. However, Client understands and agrees that:
- Every client and final delivery is different, with different tastes, budgets, and needs;
- The services provided are subjective and Contractor is a provider with a unique vision, with an ever-evolving style and technique;
- Contractor will use her personal judgment to create favorable results for Client, which may not include strict adherence to Client’s suggestions;
- Dissatisfaction with Contractor’s independent judgment or individual management style are not valid reasons for termination of this Agreement or request of any monies returned.
Shipping Protection & Damages We take great care in packaging your custom preservation, but accidents can happen during transit. Our Shipping Protection ensures your investment is covered.
Reporting Requirements
· 72-Hour Window: Email hello@nashvillefloralpreservation.com within 3 days of delivery.
· Photos Required: Provide clear photos of the damaged frame, florals, and all packaging materials (interior and exterior) for carrier claims.
Coverage Details
· Lost in Transit: Client will either be issued a full refund for the frame and all customized options, OR will cover the cost of a new creation equal in value to the frame and all customized options. Note: Client must provide a new bouquet for recreation. Covers frame damage alone.
· Damaged Items: Protection covers all return shipping costs to Nashville Floral Preservation and back, professional repair costs, and the cost to replace the frame if needed.
· Floral Repair & Replacement: * We will attempt to repair/replace damaged blooms using additional flowers from your existing preservation.
o If a flower is damaged beyond repair and no extras remain, the client is responsible for providing or funding a replacement.
· No Shipping Protection: If damaged and Shipping Protection was not purchased, the customer must ship the frame back to us withing 72 hours. The client is responsible for all shipping costs and any related repair costs including but not limited to a repair fee for time to fix the flowers. Repair fee will be determined based on photos and in-person assessment.

Craft Defects: If you experience a defect unrelated to wear-and-tear or improper hanging, reach out and we will make it right.

Note: The natural aging or fading of organic florals over time is a normal part of the preservation process and is not considered a defect.
Returns & Refunds
All Sales Are Final
Due to the highly custom nature of floral preservation, we cannot accept returns.

No Refunds: Once we receive and begin processing your bouquet, all payments are non-refundable.

WHAT TO EXPECT: PRESSED FLOWER FRAMES
Flowers undergo natural transformations during the pressing and preservation process. By commissioning a pressed piece, you acknowledge the following:
Flower Behavior & Appearance

Color & Texture: Flowers will change color during drying. Preservation may cause or enhance bruising, translucent spots, or browning.

Reflexed Blooms: Flowers styled by florists (petals folded back) will not be unfolded and may show brown spots from previous handling.

Moisture Content: Succulents and high-moisture tropicals often do not survive the pressing process or may turn entirely brown.

Selection: Not all flowers from a bouquet will be used due to thickness, condition, or frame depth constraints.
The Pressing Process

Environmental Factors: While every effort is made to ensure a clean environment, minor particles (dust or stray fibers) may occasionally be visible behind the glass.

Artistic Layout: Flowers are secured to prevent shifting; however, the organic nature of the medium means slight variations in placement are expected.

Previously Dried Flowers: These are often too brittle to press. If accepted, the Contractor is not responsible for mold, rot, or petal loss due to fragility.

Temperature Damage: Flowers stored in a refrigerator or freezer prior to delivery will likely contain rot or mold and cannot be preserved.
Color Correction & Longevity

Artistic Enhancement: Color correction is an optional service to match original hues and minimize translucent spots. It will be a close approximation, not an exact replica of the fresh bouquet.

Natural Aging: All pressed flowers will eventually fade or "amber" over time due to UV exposure and oxidation. This is a natural process for which the Contractor assumes no liability.
Frame Specifications

Dimensions: Frames typically range from 5"x7" to 16"x20".

Depth: usually ranging from 1/4" to 1" in depth.
PROPERTY RELEASE
Client agrees to deliver florals to agreed upon location at the agreed upon time. The Client agrees to release floral property to Contractor to design and execute a finished product that will be returned to the Client.
I understand that Contractor has the rights to photograph all and any products that are made through Contractor to be used on social platforms as well as in advertisements without any limitation from clients.
CLIENT RESPONSIBILITY

Flower Care & Timing: Client must provide fresh, alive flowers within four days of the event. Delivery is at the Client's own risk to the studio (residential location) via the provided bin or overnight shipping.

Deadline: If flowers aren't received within one week of the agreed date, the order may be terminated without a refund.

Third-Party Items: Contractor is not responsible for ribbons, charms, photos, or vases sent with the bouquet.

Layout Approval: If purchased, Client has one week to approve the digital layout. Changes incur a $25 fee per redesign. Final decisions on small add-on pieces rest with the Contractor.

Condition: If flowers arrive unusable (mold/rot), Client may reschedule for a $100 fee. Cancellations at this stage are non-refundable.

Display & Safety: Pressed frames should be kept out of direct sunlight and high humidity to prevent premature fading. Contractor is not liable for injuries or damages (e.g., glass breakage) after delivery.

Legal: Governed by Tennessee law. Contractor disclaims all implied warranties of merchantability or fitness for a particular purpose.
LIMIT OF LIABILITY & NON-DISPARAGEMENT

Damages: Maximum liability is limited to the total cost paid by the Client under this Agreement.

Conduct: Both parties agree not to make public defamatory statements that would harm the other’s reputation or business.
DELIVERY AND TIMELINE
-
Timeline: Completion typically takes 6–9 months, potentially up to one year.

Shipping: Finished frames are insured. If damaged in transit, insurance funds if applicable will cover a recreation (Client must provide new flowers) or will be used toward a new optional order.

Organic Shifting: Minor "dusting" of pollen or slight petal shifting during shipping is natural and not considered a defect.

Blackout Period: No shipping occurs in December due to carrier delays/theft; shipments resume in January.
SHIPMENT OF FLOWERS

Cost & Method: Client pays for overnight or next day shipping and must follow specific instructions. Never use plastic packaging, as it causes rapid rot.

Transit Risk: Contractor is not liable for lost or damaged bouquets during transit. Photos are taken upon arrival to assess if replacement flowers are needed.
CANCELLATIONS

Client Cancellation: * 3+ months notice: Refund minus a $300 retainer.

Under 3 months: No refunds due to material preparation.

Rescheduling: 30 days' notice required to reschedule within one year without a fee.

Contractor Cancellation: If the Contractor cannot fulfill the order, they will find a substitute or issue a refund/credit for services not rendered. Services are rendered once a frame is picked up by someone in contact to the customer's party or when a customer's order is delivered to a shipping company.
RETURNS
All products are made without warranty express or implied.
Personalized, custom items are sold on an as-is basis and cannot be returned.
Any claim you make for any type of damage under this contract shall be made in writing to Nashville Floral Preservation within thirty (30) days of delivery of the product you have purchased. Any failure to make a timely written claim shall be deemed a waiver by you.
FORCE MAJEURE
Either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party that materially affects the performance of Services, such as: an act of God (fires, explosions, earthquakes, hurricane, natural disasters, flooding, storms or infestation), or War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not), or any hazardous situation created outside the control of either party such as a riot, disorder, theft, nuclear leak or explosion, or act or threat of terrorism.
GOVERNING LAW
The laws of Tennessee govern all matters arising under or relating to this Agreement, including torts.
NOTICE
Parties shall provide effective notice (“Notice”) to each other, including any payments or invoices, via either of the following methods of delivery at the date and time which the Notice is sent:

SEVERABILITY
If any portion of this Agreement is deemed to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force, if the essential provisions of this Agreement for each party remain legal and enforceable.
AMENDMENTS
The parties may amend this Agreement only by the parties’ written agreement with proper Notice.
ASSIGNMENTS
Neither party may assign or subcontract any rights or obligations in this Agreement without proper Notice, unless otherwise provided herein.

The titles and section headers in this Agreement are provided for convenience only and should not be construed as part of this Agreement.
